Commission Terms
A commission is a drawing made for you, to your brief. These terms set out how that works. They apply once a commission has been agreed in writing.
Places, buildings, vehicles, animals, people and scenes drawn from photographs you supply. Kevin will tell you honestly if a subject will not work well in graphite, or if the reference photographs are not strong enough to draw from. An enquiry is not an automatic acceptance.
To be confirmed before launch: whether a deposit is required and how much, typical lead times, and how many rounds of changes are included. These are Kevin’s to set and have deliberately not been invented.
You will see the work as it develops. Small adjustments are part of the process and are expected. A change of subject, composition or size after the drawing has started is a new piece of work and will be quoted separately.
Because a commission is made to your specification and cannot be sold to anyone else, the 14-day cancellation right that applies to ordinary online purchases does not apply once a commission has been accepted and started. This is the exemption in the Consumer Contracts Regulations 2013 for goods made to a customer’s specification or clearly personalised.
If you need to cancel before work has begun, get in touch and it will be dealt with fairly.
None of the above removes your statutory rights. If a finished commission arrives damaged, is not of satisfactory quality, or is not what was agreed in writing, it will be repaired, replaced or refunded. Those rights come from the Consumer Rights Act 2015 and cannot be signed away.
By sending photographs you confirm you have the right to use them and to have a drawing made from them. If a photograph was taken by a professional photographer, the copyright is usually theirs, and their permission may be needed.
Your photographs are used only to make your drawing. They are not sold, shared or published.
To be confirmed before launch: how long reference photographs are kept after a commission is finished.
You own the physical drawing. Copyright in the artwork stays with K.P. Butler, which is the normal position for commissioned art. That means the drawing may not be reproduced, printed or sold on as an image without written permission. Full detail is on the Copyright and Image Use page.
Kevin may show the finished commission in his portfolio, on this website and on social media. If your commission is private and you would rather it was not shown, say so when you commission it and that will be respected.
Finished commissions are packed and sent as described on the Delivery and Returns page.
This page describes how PencilARTbyBee operates and is written in plain English. It is not legal advice, and it should be reviewed by the business owner — and ideally a solicitor — before the site goes live.
